50. Procedure for filing appealDefined in rule 2(a): appeal means an appeal under sub section (1) of section 49:--
-- (1) Any person aggrieved by an order passed by the authorityDefined in rule 2(d): authority means the authority appointed by the Central Government under sub section (1) of section 45 under sub-section (2) of section 45 may prefer an appealDefined in rule 2(a): appeal means an appeal under sub section (1) of section 49 under sub-section (1) of section 49 in Form-III electronicallyDefined in rule 2(j): electronically means any information submitted by email or maintained or displayed on the designated portal or mobile application or website or digital payment in any mode for the purposes of the Code or by speed post, along with documents mentioned by the appellant in the said FormDefined in rule 2(k): form means the forms appended to these rules, to the appellate authorityDefined in rule 2(b): appellate authority means the appellate authority appointed by the Central Government under sub section (1) of section 49 having jurisdiction:
Provided that no appeal by an employer shall be admitted unless at the time of preferring the appealDefined in rule 2(a): appeal means an appeal under sub section (1) of section 49, the appellant has deposited the claim amount with the appellate authorityDefined in rule 2(b): appellate authority means the appellate authority appointed by the Central Government under sub section (1) of section 49.
(2) Where an appealDefined in rule 2(a): appeal means an appeal under sub section (1) of section 49 under sub-section (1) of section 49 is entertained, the appellate AuthorityDefined in rule 2(b): appellate authority means the appellate authority appointed by the Central Government under sub section (1) of section 49 shall serve upon the respondent electronicallyDefined in rule 2(j): electronically means any information submitted by email or maintained or displayed on the designated portal or mobile application or website or digital payment in any mode for the purposes of the Code or by speed post, a notice in FormDefined in rule 2(k): form means the forms appended to these rules VIII to appear before them on the date specified in the notice and shall inform the appellant of the date so specified.
(3) In case where the employer or their representative fails to appear on the specified date, the authorityDefined in rule 2(d): authority means the authority appointed by the Central Government under sub section (1) of section 45 may hear and determine the application ex-parte.
(4) In case where the applicant or their representative fails to appear on the specified date, the authorityDefined in rule 2(d): authority means the authority appointed by the Central Government under sub section (1) of section 45 may dismiss the appealDefined in rule 2(a): appeal means an appeal under sub section (1) of section 49.
