(1) Every personDefined in section 2(m): person includes— (i) an individual; (ii) a Hindu undivided family; (iii) an association; (iv) a company registered under section 25 of the Companies Act, 1956 (1 of 1956) who has been granted a certificateDefined in section 2(e): certificate means certificate of registration granted under sub section (3) of section 12 under section 12 shall have such certificateDefined in section 2(e): certificate means certificate of registration granted under sub section (3) of section 12 renewed within six months before the expiry of the period of the certificateDefined in section 2(e): certificate means certificate of registration granted under sub section (3) of section 12.
The proviso inserted by Foreign Contribution (Regulation) Amendment Act, 2020, s. 11, dated 28th September, 2020, with effect from 29 September 2020Provided that the Central Government may, before renewing the certificateDefined in section 2(e): certificate means certificate of registration granted under sub section (3) of section 12, make such inquiry, as it deems fit, to satisfy itself that such personDefined in section 2(m): person includes— (i) an individual; (ii) a Hindu undivided family; (iii) an association; (iv) a company registered under section 25 of the Companies Act, 1956 (1 of 1956) has fulfilled all conditions specified in sub-section (4) of section 12.
(2) The application for renewal of the certificateDefined in section 2(e): certificate means certificate of registration granted under sub section (3) of section 12 shall be made to the Central Government in such form and manner and accompanied by such fee as may be prescribedDefined in section 2(o): prescribed means prescribed by rules made under this Act.
(3) The Central Government shall renew the certificateDefined in section 2(e): certificate means certificate of registration granted under sub section (3) of section 12, ordinarily within ninety days from the date of receipt of application for renewal of certificateDefined in section 2(e): certificate means certificate of registration granted under sub section (3) of section 12 subject to such terms and conditions as it may deem fit and grant a certificateDefined in section 2(e): certificate means certificate of registration granted under sub section (3) of section 12 of renewal for a period of five years:
Provided that in case the Central Government does not renew the certificateDefined in section 2(e): certificate means certificate of registration granted under sub section (3) of section 12 within the said period of ninety days, it shall communicate the reasons therefor to the applicant:
Provided further that the Central Government may refuse to renew the certificateDefined in section 2(e): certificate means certificate of registration granted under sub section (3) of section 12 in case where a personDefined in section 2(m): person includes— (i) an individual; (ii) a Hindu undivided family; (iii) an association; (iv) a company registered under section 25 of the Companies Act, 1956 (1 of 1956) has violated any of the provisions of this Act or rules made thereunder.
